Term of Services

Terms and Conditions

Small Call to Action Headline

Effective Date: December 7th, 2023

Last Updated: October 30th, 2026

Please read these terms and conditions carefully before using Our Service.

These Terms govern websites, educational programs, courses, community access, digital resources, and related educational services offered by Blue Is The New White Enterprises, Inc. (“BITNW,” “we,” “us,” or “our”).

BITNW CRM subscriptions are governed by the separate BITNW CRM Terms of Service. Buying an Academy product does not include CRM access unless expressly stated.

1. Acceptance and Eligibility

Paid purchases and account registration require affirmative acceptance of the applicable terms.

You must be at least 18 and legally able to enter the agreement. If you act for a business, you represent that you have authority to bind it.

The agreement includes these Terms and the offer or order accepted at purchase. A specific written offer controls the commercial details of that purchase.

Our Privacy Policy explains how we handle personal information. Acceptance of these Terms does not substitute for separately required payment or marketing consent.

2. Educational Services

We provide educational content intended to help participants develop business, leadership, financial literacy, and related skills.

The offer will identify what is included, the access period, any live sessions, any membership features, and the applicable price.

Unless expressly included, a purchase does not provide individualized consulting, implementation services, professional certification, academic credit, or ongoing access to every future product.

Third-party technology, including CC360 and its underlying providers, may support course delivery and account access.

3. Accounts and Access

Provide accurate account information and reasonably protect your credentials.

Access is personal to the purchaser or the authorized users identified in a business purchase. You may not share an individual login, resell access, or exceed purchased seat limits.

Notify us promptly of suspected unauthorized access.

We are responsible for our own security obligations. Your account responsibilities do not excuse a breach attributable to us.

4. Prices and Payment

The price, payment schedule, included features, and access period will be disclosed before purchase.

A payment plan for a fixed purchase is different from a cancelable subscription. An obligation to complete installments must be clearly disclosed and accepted before purchase.

We may use authorized payment or invoicing providers. Applicable taxes may be added as disclosed.

We will not charge an undisclosed fee or treat acceptance of general terms as authorization for unrelated purchases.

5. Subscriptions, Trials, and Automatic Renewal

A subscription renews automatically only when that arrangement is clearly disclosed and affirmatively accepted.

Before enrollment, the offer will disclose the recurring charge, billing frequency, trial or promotional expiration, cancellation method, and any minimum commitment.

Unless a different lawful arrangement is expressly accepted, you may cancel renewal through an available account control or by emailing [CONTACT EMAIL]. Cancellation takes effect at the end of the current paid period.

We will not require unnecessary steps or delay a cancellation because we have not acknowledged it. Where applicable law requires another cancellation method or timing, we will comply.

Revoking automatic payment authorization does not eliminate a valid payment obligation already incurred. A clear request to cancel the subscription will also be treated as cancellation.

We will provide at least 30 days’ advance notice of a recurring price increase, with an opportunity to cancel before the increase applies. A fixed-price commitment will not be changed during its agreed term without agreement.

6. Refunds and Cancellations

Any product-specific refund period, satisfaction guarantee, event cancellation policy, or rescheduling arrangement must be disclosed before purchase.

If no additional refund right is offered, purchases of digital content are nonrefundable after access is provided, and subscription fees are not prorated for a voluntary cancellation during a paid period, except as required by law.

This does not eliminate remedies for an unauthorized charge, material misdescription, failure to deliver, or other legally protected circumstance.

If we cancel a paid offering and do not provide an agreed reasonable substitute, we will refund the amount attributable to the undelivered portion.

Where local law requires express consent before immediate digital delivery affects a withdrawal right, we will obtain that consent separately.

7. Access Period and Changes

Access lasts for the period disclosed in the offer.

We may update content and technology. We will not materially reduce an expressly purchased entitlement without providing a reasonable remedy.

No promise of “lifetime access” applies unless the accepted offer defines whose or what lifetime is intended and the conditions that apply.

If we discontinue an ongoing paid service, we will provide reasonable notice and any refund or other remedy required by the agreement or law.

8. Our Intellectual Property

BITNW and its licensors retain their rights in courses, videos, recordings, presentations, workbooks, templates, branding, and other educational materials.

You receive a limited, nonexclusive, nontransferable license to use purchased materials for your own learning and permitted internal business use during the applicable access period.

You may apply the ideas and skills you learn. You may not reproduce or distribute the course itself, resell our materials, upload them to a shared repository, or use them to deliver a competing course without permission.

Downloading a resource where permitted does not transfer its copyright or authorize redistribution.

These restrictions do not limit rights expressly granted in the resource or rights protected by applicable law.

9. Your Submissions and Community Participation

You retain rights in content you submit.

You grant us a limited license to host, display, reproduce, and process your submission only as reasonably necessary to provide the feature you use.

Content posted in a community space may be visible to its intended participants. Content submitted privately for support or feedback is not licensed for public advertising merely because you submitted it.

We will obtain separate permission before using an identifiable testimonial, private submission, or participant likeness for promotional purposes where required.

Do not upload confidential customer information, information you lack permission to disclose, or sensitive personal information into a community discussion.

10. Live Sessions and Recordings

If we intend to record a live session, we will give notice and obtain any legally required consent.

We will explain the intended audience or use of the recording. Participation does not grant an unrestricted right to use your image or statements in unrelated advertising.

If a reasonable nonrecorded participation option is available, we will explain how to use it.

Participants may not record or redistribute sessions without permission and any required consent from other participants.

11. Community Standards

You must not use the services to engage in unlawful conduct, harassment, threats, infringement, fraud, impersonation, or unauthorized solicitation.

We may moderate or remove content and restrict access when reasonably necessary to enforce these rules or protect participants.

Except where immediate action is needed, we will provide notice and a reasonable opportunity to address a material violation.

Enforcement will not be used to suppress a legally protected honest review or other nonwaivable right.

12. Educational Disclaimers

Our content is educational. It is not individualized legal, tax, accounting, investment, medical, or other regulated professional advice.

Examples, forecasts, and case studies do not guarantee results. Results depend on your circumstances, decisions, execution, and other factors.

Descriptions of another person’s experience do not establish that it is typical. Any specific performance claim must be supported by its accompanying disclosures.

You are responsible for obtaining professional advice where appropriate and verifying information before making significant decisions.

13. Third-Party Resources and AI

We may reference third-party resources or use technology providers to deliver services. Their independent products and activities may be governed by separate terms.

We will disclose material affiliate or compensation relationships where required.

If AI-assisted features or materials are used, users should review outputs for accuracy. Such features do not replace qualified professional judgment.

We remain responsible for our own express commitments and legally required disclosures.

14. Service Quality and Limitations

We will provide purchased educational services with reasonable care and substantially as described.

Except for express promises and to the extent permitted by law, we do not warrant uninterrupted access, error-free content, or a particular business outcome.

Nothing in these Terms excludes a nonwaivable warranty or remedy.

15. Suspension and Termination

You may stop using the services and cancel renewal as described above.

We may restrict or terminate access for a material breach, unlawful use, security risk, or a binding provider requirement. Where practical, we will provide notice and an opportunity to resolve the issue.

If we end paid access without your material breach, we will refund prepaid amounts attributable to access we will not provide.

Provisions concerning intellectual property, confidentiality where applicable, valid payment obligations, and dispute resolution survive termination as appropriate.

16. Liability

To the extent permitted by law, neither party is liable to the other for indirect, consequential, special, exemplary, or punitive damages arising from these Terms.

BITNW’s aggregate liability arising from an affected purchase or subscription will not exceed the greater of $500 or the amounts paid for that offering during the 12 months preceding the event giving rise to the claim.

These limitations do not apply to fraud, willful misconduct, gross negligence, or liability that cannot lawfully be excluded or limited.

Nothing restricts a consumer’s nonwaivable statutory rights.

17. Governing Law and Disputes

Arizona law governs to the extent permitted by applicable law.

For business purchasers, disputes will be heard in the state or federal courts located in Maricopa County, Arizona, unless mandatory law requires otherwise.

For consumers, this provision does not remove mandatory protections of their place of residence or require a forum that applicable law prohibits.

The parties will first attempt to resolve concerns in good faith by contacting [CONTACT EMAIL]. This does not delay an urgent remedy or a statutory deadline.

These Terms do not impose mandatory arbitration.

18. Changes and General Terms

We may update these Terms prospectively and will provide reasonable notice of material changes affecting ongoing paid services.

A change will not retroactively alter an accepted purchase or materially reduce a fixed commitment without the agreement or remedy required by law.

If a provision is unenforceable, the remaining provisions continue to the extent lawful. Failure to enforce a provision is not a waiver.

These Terms and the accepted offer constitute the agreement for the covered purchase, except for separately signed agreements that expressly apply.
